Video Gaming Client Acquires Tom Clancy Rights

April 8, 2008

Further demonstrating its leadership in the interactive gaming industry, Greenberg Glusker today announced that it successfully negotiated and closed one of the most significant video game deals in the industry.  Greenberg Glusker attorneys Stephen Smith and Candace Carlo represented Ubisoft Entertainment, one of the world’s largest video game publishers, in an acquisition of rights from bestselling author Tom Clancy for use of his name and likeness in connection with interactive games, related books and motion pictures.

"The size and sophisticated nature of this deal required a legal team with very specific industry expertise,” said Ubisoft’s General Counsel Cecile Russeil.  “Steve’s experience in the video gaming business, coupled with Candace’s entertainment expertise in intellectual property rights acquisition deals, proved to be  the right solution for a successful transaction.”

Under the agreement, Ubisoft acquired outright all the intellectual property rights necessary to use Tom Clancy’s name and likeness for use in video games, books and motion pictures.  This assures that Ubisoft’s most successful and critically acclaimed franchises will continue far into the future.

“This transaction further demonstrates that the video gaming business is no longer a niche business within the larger Hollywood entertainment landscape, but is a stand-alone player in its own right,” said Smith.

“Providing Ubisoft with the expertise needed to successfully complete this transaction required an experienced team,” said Carlo.  “Our ability to assemble such a team on short notice is one of the reasons our existing clients trust us with their business and new clients seek us out.”

This deal follows closely on the heels of a $13.2 million arbitration award, which Smith and his team at Greenberg Glusker obtained for Ubisoft earlier this year in a licensing dispute against MGA Entertainment, the owner of Bratz™ dolls.
