Natalie Reed’s practice focuses on environmental law and litigation, environmental cost recovery, air quality, CEQA compliance and litigation, land use, climate change and environmental insurance coverage litigation.

Natalie also has experience in municipal law and governmental litigation.

Prior to rejoining Greenberg Glusker, Natalie served as a Deputy County Counsel for two large northern California counties. Natalie’s work as a Deputy County Counsel focused on natural resource and land use matters and included acting as legal advisor to the Planning Commission, Local Agency Formation Commission, numerous special districts, and a Power Authority.

Environmental Experience

  • Assisted dairy trade groups in intervening in litigation arising out of regulation of agricultural emissions in the San Joaquin Valley, which resulted in favorable decisions for the trade groups. Ass’n of Irritated Residents v. San Joaquin Valley Unified Air Pollution Control Dist., 168 Cal.App.4th 535 (2008) and Latino Issues Forum v. United States Envtl. Prot. Agency, 558 F.3d 936 (9th Cir. 2009). 
  • Assisted in representing a local public entity in a dispute with a pollution liability insurer over the costs of remediating extensive soil contamination in a major public works project.  The matter was successfully resolved following mediation.   
  • As a Deputy County Counsel, assisted Siskiyou County Counsel in responding to a novel writ of mandate suit seeking to extend the Public Trust Doctrine to groundwater interconnected with surface waters of the Scott River based on the California Supreme Court's holding in National Audubon Society v. Superior Court, 33 Cal.3d 419 (1983). 
  • Assisted in the representation of a city in connection with environmental issues associated with a county-regulated oil field, including response to an environmental impact report.   
  • As a Deputy County Counsel for Siskiyou County, reviewed environmental documents and advised County departments on compliance with the California Environmental Quality Act.

Municipal Experience

  • Assisted County Counsel in successfully defending the County Clerk in a high-profile writ of mandate case challenging the Clerk's removal of a local environmental measure from the November 2010 ballot.  Issues in the case included the appropriate designation of an elections official, estoppel theories as applied to government officials, and pre-election review of the initiative's constitutionality.
  • Assisted  the Siskiyou  Power Authority in successfully taking possession of a 5 kw hydroelectric facility and drafted its Hydroelectric Facility Operations and Management Agreement.  Assistance to  the Authority  included advising on  its powers and those of its member entities and on all aspects of the transfer, including the re-assignment and interpretation of an associated power purchase agreement with Pacific Power and Light Company.
  • Acted as legal advisor to the Siskiyou County Planning Commission and advised the Commission during a SMARA enforcement hearing regarding whether to uphold the issuance of an Order to Comply to a local mining operation.   Issues in the enforcement hearing centered on interpretation of the SMARA exemption requirements found under section 2714 of the Public Resources Code.        
  • Advised  Resource Conservation Districts, Recreation and Parks Districts, Community Services Districts, and a Flood Control and Water Conservation District on  their respective  legal powers, responsibilities, and limitations and assisted  the  special districts with Brown Act and Public Records Act compliance.
  • Advised elected and appointed officials on conflicts of interests under Government Code Section 1090 and the Political Reform Act, including the board of directors of two Resource Conservation Districts in connection with a controversial watershed-wide ITP permitting program.
  • Advised elected and appointed officials on incompatible offices under the common law doctrine of the same name.
