Project Development

Greenberg Glusker represents our clients in the development of real property from start to finish.  With the assistance of our land use attorneys, we advise clients beginning with the acquisition of the land, through its entitlement and construction, and then into the final phase of finance, management and/or disposition.  For both new developments and repositioned assets, our attorneys regularly negotiate the terms and documents for the design and construction of all types of improvements, including industrial facilities, Class A office renovations, and high-end residential properties.

Representative Projects 

  • Represented the Oakland Athletics baseball club in the acquisition and development of approximately 140 acres of land for a new baseball stadium and entertainment and residential project to be located in Fremont, California.
  • Represented Tolkin Group in the Claremont Village Expansion Project, a 125,000- square-foot specialty lifestyle center, and the Metlox Project, an upscale retail project in Manhattan Beach’s commercial walking district.
  • Counseled The Sunrise Company in its acquisition and development of Sunrise Country Club, Rancho Las Palmas Country Club, Monterey County Club, The Lakes Country Club, Palm Valley County Club, Indian Ridge Country Club, Toscana Country Club and PGA West residential. Counsel included obtaining entitlements from the City of Indian Wells as to Toscana, acquisition and construction financing, Department of Real Estate filings, sales documents and CC&Rs.
  • Advised The Foothills Group in the development of the Dragon Ridge Golf Club and development of surrounding custom home lots in Henderson, Nevada.

Representative Experience

  • Advised the Major League Soccer franchise, San Jose Earthquakes, in the construction of their $90 million stadium.
  • Advised the Los Angeles Country Club concerning the design and construction of the Club’s north course restoration project.
  • Represented Transpacific Development Company in the negotiation of a contract with Turner Construction for construction of a Class A office building in downtown Los Angeles.
  • Advised a regional mall owner in the negotiation of a construction contract for a large scale remodeling.
  • Represented a well-known entrepreneur in the construction of an approximately 30,000 square foot home on three adjoining properties in Bel Air, which included the assembly of a team of architects, engineers and contractors for the project.
  • Represented a producer of children’s programming in the construction of an approximately 40,000 square foot home on two adjoining lots in Beverly Park, on the Westside of Los Angeles.

Land use policies and procedures are constantly in flux and vary widely among different regional and local jurisdictions. A deep understanding of these myriad regulatory regimes -- as well as the interplay between them -- can mean the difference between development success and failure.

Greenberg Glusker has a fully integrated Land Use Practice representing commercial, industrial, residential and hospitality industry interests. Our clients are lenders, golf course, hotel and resort operators, office and shopping center developers, big-box retail developers, commercial and residential brokerage firms, construction companies and real estate investors in a wide variety of transactions. Our project experience ranges from routine entitlement approvals to large, multiphase master planned developments.

Our Real Estate Group combines comprehensive and strategic land use advice with a pragmatic problem-solving approach. Our practice background and expertise includes general plans, specific plans, subdivisions, variances, conditional use permits, zone changes, site plan reviews, development agreements, coastal development permits, initiatives and referenda, and similar entitlement issues our clients encounter.

We often act as land use counsel on transactions that involve particularly sensitive biological or natural resources or involve emerging environmental or land use issues. We manage issues such as compliance with evolving greenhouse gas emission development requirements and limitations, mitigation of impacted environmental resources, public-private land developments arrangements, and innovative, mixed-use urban infill projects. Our counsel on special purpose projects includes warehousing and distribution, soundstages, motion picture production and post-production facilities, and light and heavy industrial projects.
