Copyright Termination and Loan-Out Corporations: Reconciling Practice and Policy

On January 1, 2013, the first generation of copyright transfers made under the 1976 Copyright Act will become eligible for statutory termination, enabling creators of copyrighted properties and their heirs to unwind their own transactions and reacquire potentially valuable rights to long since transferred works. The implications for successful, enduring franchises created after 1978 could be dramatic.
