Britney Spears' conservatorship: Why 'people are figuring this out as they go'

Probate, Trusts, & Estates Litigation Chair, Benny Roshan, provided insight to Yahoo! Finance regarding Britney Spears' fight to end her court-ordered conservatorship. The legal arrangement grants Britney's father authority of her personal and financial affairs. Benny equates Britney's refusal to perform equivalent to a "peaceful protest."

"Performing arts is her profession, so if she's not going to generate any income, then that is something that impacts her earning ability," Los Angeles-based attorney Benny Roshan, who serves as chair of Greenberg Glusker's trusts and probate litigation group, told Yahoo Finance.

"How many different ways can a person start jumping up and down about what it is that they don't want before somebody listens?" Roshan continued. 

"For Britney to manage and be in charge of her own affairs, she will have to get a court order to formally terminate the conservatorship, and then she will be free to make her own decisions."

"The probate code is silent on requiring a psychiatric evaluation. That is not a requirement of terminating a conservatorship," she said — despite the fact that Spears' testimony revealed she was specifically told she needed one.

"So in a scenario like this, where we have a younger adult, there really isn't a lot of precedent. In a lot of ways, people are figuring this out as they go, because you're not going to find a lot of support in case law," she explained.

"In my generation, this is the first time observing a conservatorship of an adult person who is not elderly, who is very high profile and whose conservatorship has played out so publicly," she added.
