Brian Davidoff, Chair of the firm's Bankruptcy Group, moderated the panel "Distressed Transactions" during the Association for Corporate Growth (ACG) - Los Angeles' Annual Business Conference. In addition to Brian, the panel featured: Paul L. Kessler, who is the Principal at Bristol Capital Advisors and Cynthia Nelson, who is a Senior Managing Director in the Corporate Finance division of FTI Consulting.

This program focused on alternative structures for conducting a sale of distressed assets, with specific focus on bankruptcy 363 transactions. The panel covered the legal, financial, and consulting aspects of this type of sale, with each panelist providing their unique perspective. Brian provided an overview of the different forms of distressed transactions, including the responsibility of officers and directors when a company is insolvent; Paul gave us his perspective as a buyer of distressed assets; and Cynthia gave us insight into the tug of war that often occurs among management when a company is faced with a distressed sale of assets.
