Dominion Voting Systems v. Fox News

In a radio interview, litigation partner and free speech expert Doug Mirell discussed the $1.6 billion defamation lawsuit brought by Dominion Voting Systems which alleges that Fox News personalities claimed that Dominion’s voting machines were responsible for rigging certain vote counts in the 2020 presidential election.

"A public figure, . . . in order to win in a defamation case, has to demonstrate actual malice on the part of the defendants. This means that they know that what they are saying is false or that they are doing so with reckless disregard for the truth."

"The worst case scenario may not involve Fox News itself. Fox Corporation, the parent which has many more assets than Fox News, brought a motion earlier this year to try to extricate itself from the lawsuit. In late June, the Delaware Superior Court denied that motion. So not only is Fox News on the hook, but also Fox Corporation."

"When a news outlet, such as Fox, does what Dominion has alleged, they need to worry. Their anchors need to be concerned about adopting views that have not been proven and that, ultimately, have shown to be debunked."
