16th Annual Environmental Law Fall Symposium

Private citizens are conferred standing to pursue enforcement actions for alleged violations of the Clean Water Act, Clean Air Act, and RCRA, among other statutes.  Along similar lines, many stakeholder groups have been successful in effecting changes to regulatory standards, and influencing decisions by regulatory bodies.  Proponents would argue, especially with evolving federal enforcement policy, such measures are critical to ensuring compliance with laws.  Opponents contend many regulatory decisions are being unduly influenced by political considerations, rather than sound science.  This panel will debate these issues in the context of several case studies focused on a Superfund site, a recent challenge to the State MCL for hexavalent chromium, and Statewide stormwater permit lawsuits.
