California’s Proposition 65: Background, Compliance, and Strategy

Under California's Safe Drinking Water and Toxic Enforcement Act of 1986, more commonly known as “Proposition 65,” businesses must not knowingly or intentionally expose people to chemicals known to the State of California to cause cancer or reproductive harm without a prior "Clear and Reasonable Warning." We will provide a general overview of the "Clear and Reasonable Warning" requirements, and discuss some common compliance pitfalls and potential regulatory changes, including those related to “short-form warnings,” on which the regulated community heavily relies.
