Litigation Chair, Aaron Moss, will be moderating the panel "Latest Developments in Copyright Termination Law" at The Copyright Society of the USA's 2022 Midwinter Meeting on February 11, 2022.

The panel will be discussing latest developments in U.S. copyright termination law and issues raised by recent cases that are calling for the re-examination of core copyright principles in the context of copyright termination by answering the following questions:

  • What constitutes a grant “covering the right of publication?"
  • Can sound recordings released as part of an album qualify as a “contribution to a collective work” and therefore be eligible as a specifically commissioned work for hire?
  • What constitutes a new derivative work for purposes of the Derivative Works Exception?
  • Is an assignment of the right to receive royalties subject to termination?

Aaron Moss represents owners and users of creative content and litigates high-profile copyright and trademark actions for both plaintiffs and defendants, including studios, independent distributors, production companies, video game publishers, toy companies, apparel manufacturers, technology firms and individuals.
