New California Law May Pave Way For More Pay Equity Suits

Employment Partner Karina Sterman shared her insights with Law360 on S.B. 642, a new law that modifies employers’ pay disclosure obligations and expands employees’ ability to sue and recover damages for pay discrimination.

Sterman noted that S.B. 642 includes "obvious" triggers that lead to a pay discrimination claim, such as an employee claiming they were themselves underpaid in violation of the law. But S.B. 642's inclusion as a potential cause of action when an "alleged unlawful compensation decision or other practice is adopted" could be read to allow workers who haven't themselves been personally affected or suffered harm from a pay practice to sue a company over how other employees were paid, she said.
