First Amendment attorney Doug Mirell said an ordinance cannot inhibit more assembly rights than are absolutely necessary to serve that governmental purpose, which the City’s latest ordinance does.

“I think the City has gone overboard and reacted inappropriately to a single instance where one group of folks were protesting for a few hours late at night,” Mirell said.
