AI Tools Creating Digital Paper Trails That Could Haunt Companies in Court

But an outright ban isn’t always practicable, said Peter Jackson, an attorney at Greenberg Glusker Fields Claman & Machtinger who focuses on intellectual property, data and privacy issues.

“Some businesses, perhaps more than others, are probably not taking into adequate consideration the volume of data that is being recorded by a variety of applications they may use or their employees may use without their knowledge,” he said. “It’s now easier than ever to integrate new services and applications via the web, and also you can’t ensure that every employee is going to respect workplace policies and not use their personal devices to do some of those things.”

“If people can tell you, ‘Yes, the sales team uses Loom,’ there’s no reason it would be treated any differently from the perspective of a regulatory body,” Jackson said. “They will think of that as fair game and there would probably be an expectation to disclose the use of those tools if they’re known to be licensed by the business.”
