Energy Cases To Watch In The 2nd Half Of 2024
August 26, 2024 – Media MentionNoah Perch-Ahern, Environmental Partner, spoke to Law360 about a climate change tort lawsuit that energy attorneys are closely watching this year.
Excerpts:
The justices have largely steered clear of the climate torts lodged against fossil fuel companies under state law by state and local governments. But their request for U.S. Department of Justice input on a petition lodged by ExxonMobil Corp., Chevron and other companies seeking to reverse the Hawaii Supreme Court's decision to keep Honolulu's case alive shows that the justices are increasingly interested in resolving whether climate torts belong in state or federal court, said Greenberg Glusker Fields Claman & Machtinger LLP environmental partner Noah Perch-Ahern.
"They're not quite sure yet whether they should take up this issue," Perch-Ahern said. "But asking the solicitor general what they think means that they're taking it seriously, and one of the grounds for Supreme Court review could be met here."
