High Court Should Take Up $1 Billion Copyright Case, US Says

Litigation Partner Steven Stein shared his thoughts with Bloomberg Law regarding the nuances of Cox Communications Inc.'s appeal against a finding of contributory copyright infringement.

Entertainment and IP attorney Steven A. Stein of Greenberg Glusker said he didn’t find the solicitor general’s stance surprising given the verdict’s unprecedented and “sweeping view” of liability. It would be good for the high court—if not also Congress—to clarify the DMCA’s scope with regard to ISPs, he said, noting Sauer’s point that the law was written during the early stages of the internet.

“Where’s the line? The better answer is that it’s unclear what the line is,” said Stein, adding that he’d be surprised if the court declined to hear the case. “The statue at issue doesn’t really draw that line.”
