Doug Mirell, litigation partner and First Amendment expert, shared his insights regarding a lawsuit in which Dominion Voting Systems, an election technology company, is seeking $1.6 billion in damages from Fox News Network and its Fox Corp parent for allegedly spreading false claims that Dominion’s voting machines were used to rig the 2020 U.S, presidential election. Dominion seeks to prove that Fox either knew that the statements they aired were knowingly false or were broadcast with reckless disregarded for their truth.

Doug Mirell, a defamation lawyer who has followed the litigation, said he believes Dominion has an "air-tight" case for actual malice because Fox hosts pressed forward with vote-rigging allegations "well after it was quite clear that these claims were demonstrably false."
