Bankruptcy Partner Jonathan Shenson spoke with Law360 about the Eleventh Circuit taking on a case involving termination rights under the Copyright Act. It will be the first appellate court to examine the tension between the Copyright Act and the Bankruptcy Code.

For parties trying to negotiate settlements within bankruptcy, a looming future termination right can create uncertainty and risk, according to Jonathan Shenson of Greenberg Glusker.

"It's going to impact the value of the asset," Shenson said. "It creates an unbelievable challenge for dealing with these assets unless there's some decisional law or some amendment to these codes. There's an irreconcilable difference between the Copyright Act and the principles of the Bankruptcy Code."
