With the memory of the Great Recession still fresh in the nation’s collective memory and its wealth in flux, many individuals in a position to take advantage of the fact that the gift and estate tax exemption has temporarily shot up to $11.0 million under the 2017 Tax Act are, nevertheless, hesitant to relinquish significant assets, fearful that another economic downturn could reveal that they had given away more than they could reasonably afford to live without.

Accordingly, rather than establishing trusts for the exclusive benefits of their descendants, many clients wishing to use their exemption but seeking security are establishing Spousal Lifetime Access Trusts (“SLATs”).
