CLE Last Dash | Bankruptcy and Its Alternatives: A Practical Decision-Tree for Distressed Businesses

Businesses under financial stress rarely have a single “right” answer—especially in today’s environment of tighter credit, contested valuations, and heightened litigation risk. In this one-hour, practical CLE, Keith Banner and Uzzi Raanan will walk attendees through a decision-tree for navigating bankruptcy and its key alternatives, including consensual workouts, forbearance arrangements, UCC/Article 9 strategies, assignments for the benefit of creditors (ABCs), and receiverships, and how to identify the inflection point where Chapter 11 (or liquidation) becomes the best option.
 
The program will focus on what lawyers need to spot early: stakeholder alignment, liquidity runway, collateral realities, executory contract and lease pressures, director/officer duties, and the litigation “tail risk” (preferences, fraudulent transfer exposure, lender liability, and post-transaction challenges).

This program is approved for 1 hour of general California MCLE credit.
