California Whistleblower Protections: New Requirements for 2025

Under Labor Code Section 1102.8, California employers are required to prominently display a list of employees’ rights and responsibilities under state whistleblower laws. However, existing law does not provide specific guidance other than requiring that the posting’s type size be larger than 14-point font and include the State Attorney General’s whistleblower hotline telephone number.

Effective January 1, 2025, AB 2299 introduces new requirements for this posting. Labor Code Section 98.11 mandates that the California Labor Commissioner develop a model list of employees’ rights and responsibilities under existing whistleblower laws. Employers who post this model list will automatically be deemed in compliance with the requirement to display these protections prominently.

Employers should act now to download the official model list, ensure it is displayed in accordance with the law, and review internal processes to prevent retaliation against whistleblowers. The model list can be accessed directly here.
