Nike’s 7/11 Air Max Launch Hampers Chances Against 7-Eleven Suit
Bloomberg Law
Intellectual Property Litigation Partner Steve Stein spoke with Bloomberg Law about 7-Eleven's trademark lawsuit against Nike.
Excerpts:
But releasing the shoes on “7-Eleven Day,” known for the store’s free Slurpees, and promoting the shoe as “the flyest way to get around, even if you’re just strolling down to the corner shop” left little doubt that the shoe was an homage, IP attorney Steven Stein of Greenberg Glusker said.
“If Nike just had a shoe, with these three colors on the shoe, and that was it, maybe we wouldn’t be having this conversation,” Stein said. “There’s certainly circumstantial evidence reflecting that it was Nike’s intent to reference 7-Eleven.”
“‘Just Do It’ is a great slogan,” he said. “But it’s a bad idea when it comes to using another company’s IP.”
