Litigation Partner Steve Stein shared his insights with Law360 on key copyright law cases to watch in 2026.

But there could be an easier way out of this case for the Supreme Court where it could avoid upsetting the status quo on ISP liability. For instance, Steven Stein of Greenberg Glusker Fields Claman & Machtinger LLP noted that part of Cox's challenge has been over the adequacy of jury instructions on willfulness, and the justices could reverse on that issue.
But Stein, like others, said the Supreme Court seems to have taken up this case because of its significance. Anyone using the internet uses an ISP, so major changes in how those companies would address infringement as a result of this decision would affect many individuals.
"This case isn't just one that has some sort of theoretical or legal implications," Stein said. "It has significant practical implications that could affect all of us, really."
